SAN FRANCISCO (AP) - California's Supreme Court says employers can fire workers for using medical marijuana.
The state's high court upheld a telecommunications company's decision to terminate an employee who was using the drug. The emloyee was fired after failing a drug test.
The worker, Gary Ross, had a marijuana card authorizing him to legally use the drug to treat a back injury he got while serving in the Air Force.
The company, Ragingwire, successfully argued that it rightfully fired Ross because all marijuana use is illegal under federal law, which doesn't recognize medical marijuana laws in California and 11 other states. The company also says it feared becoming the target of a federal raid.
Ross argued that medical marijuana users should receive the same workplace rights that employees with valid painkiller prescriptions do. A nonprofit marijuana advocacy group representing Ross estimates that 300,000 Americans use medical marijuana.
