Kin want right to sue after NC man assumed dead

RALEIGH, N.C. (AP) - North Carolina’s appeals court is considering a lawsuit filed after a living man was declared dead, zipped into a body bag and taken to a morgue.
The News & Observer of Raleigh reported Thursday that judges are considering whether to allow the lawsuit, which contends the mistake led to injuries from which Larry D. Green might never recover.
Green’s family and guardian sued Franklin County officials to recoup money for the 24-hour care the 34-year-old needs in a rest home.
A state attorney argued that medical examiner J.B. Perdue is immune from liability as a public official. North Carolina law typically gives broad protections to civil servants who make mistakes on the job.
A Franklin County judge ruled this year that Perdue should face legal liability.
