Nifong's investigator seeks to dismiss civil case

(AP) - The chief investigator for former Durham County prosecutor Mike Nifong wants a court to dismiss a civil lawsuit filed against him by the three players falsely accused in the Duke lacrosse rape case.


Linwood Wilson said he was protected by prosecutorial immunity since he was acting under the direction of Nifong, the former Durham district attorney who was later disbarred for misconduct in the case.


Wilson's motion was filed in U.S. District Court in Greensboro.


The motion says the immunity claim would include Nifong's decision to withhold exculpatory DNA evidence from attorneys for the three now-exonerated players. It calls allegations that Wilson was involved in a conspiracy to conceal and fabricate DNA evidence "nothing more than conclusory."


Attorneys for formerly accused players Reade Seligmann, Collin Finnerty and Dave Evans filed a sweeping federal lawsuit in October.
