RALEIGH, N.C. (AP) - A special prosecutor is taking over the case against a man who spent three years in prison before prosecutors dropped a murder charge then filed an accessory charge.
The North Carolina Administrative Office of the Courts said Tuesday that W. David McFadyen Jr. will take over the case against 21-year-old James Johnson. McFadyen is a retired district attorney with 26 years of experience.
A Wilson County jury indicted Johnson in January in connection to the 2004 slaying of 17-year-old Brittany Willis.
Kenneth Meeks was convicted in the killing and said Johnson aided him in the crime, but Meeks later recanted. Johnson told police he went to the crime scene with Meeks and to a car wash to clean Meeks' vehicle, but only because he feared for his own life.
Johnson is now charged with accessory after the fact of first-degree murder.
